- Plaintiff, Sptime Zulku, sued Defendant, I.Q. Data International, Inc. for sending her form letters in an attempt to collect a debt that allegedly violate the Fair Debt Collection Practices Act, 15 U.S.C § 1692, et seq. (“FDCPA”), by allegedly contradicting or ‘overshadowing’ a consumer’s rights to dispute or verify an alleged debt; by falsely and deceptively representing that the debt was not increasing due to interest; and falsely stating that interest was due when Defendant had not legal or contractual authority to collect interest.
- The Court has not ruled on the merits of the claims, and Defendant does not admit liability or concede the truth or validity of any of the allegations.
- You have been sent this notice because according to Defendant’s records, you received the debt collection letter or letters that are at issue in this lawsuit in the time period between June 2, 2018 and June 2, 2019.
Your Legal Rights and Options in this Settlement:
You will receive a check for your pro rata share of the Settlement Fund, estimated to be around $388. By doing nothing and receiving the check, you give up your legal right to bring an individual lawsuit against Defendant for claims covered by this Settlement or that could have been covered by this Settlement..
Exclude Yourself: You can ‘opt-out’ of the Settlement and preserve your right to sue individually as outlined below and by the deadline listed below..
Write to the Court about why you don't like the settlement and do not want it approved. Act by September 25, 2019. See section 11 for more details.
Go to a Hearing:
Ask to speak in Court about the fairness of the settlement on November 19, 2019. See section 13 for more details.
The Court in charge of this case still has to decide whether to approve the Settlement. Payments will only be made once the Settlement has been approved and after any appeals are resolved. Please be patient.
