Please Take Notice that On December 2, 2016 at 10:00 a.m. (ET), a hearing (the “Confirmation Hearing”) was held before the Honorable Kevin Gross, United States Bankruptcy Court for the District of Delaware, 824 North Market Street, 6th Floor, Courtroom #3, Wilmington, Delaware 19801, to consider confirmation of the Amended Plan of Reorganization of the Debtor Pursuant to Chapter 11 of the Bankruptcy Code [D.I. 119] (the “Plan”).  The Confirmation Date and Effective Date occurred on December 9, 2016.

Meeting of Creditors

Please Take Notice that the meeting of creditors pursuant to section 341 of the Bankruptcy Code (the "Meeting of Creditors") was held at 844 King Street, Room 2112, Wilmington, DE 19801, on October 18, 2016 at 9:00 a.m. (ET).

Rule 9001(5) of the Federal Rules of Bankruptcy Procedure requires that a representative of the Debtor appear at the Meeting of Creditors for the purpose of being examined under oath by a representative of the Office of the United States Trustee and by any interested parties that attend the meeting. Creditors were welcome, but not required, to attend the meeting.

Disclosure Statement Hearing

PLEASE TAKE FURTHER NOTICE THAT a hearing (the “Disclosure Statement Hearing”) was be held before the Honorable Kevin Gross, United States Bankruptcy Judge, at the United States Bankruptcy Court for the District of Delaware, 824 N. Market Street, 6th Floor, Courtroom #3, Wilmington, DE 19801, on November 2, 2016 at 10:00 a.m. (ET) to consider the entry of an order approving the Disclosure Statement as containing “adequate information” within the meaning of section 1125 of the Bankruptcy Code. The Disclosure Statement may be amended or modified at or prior to the Disclosure Statement Hearing by the Debtors, and the Disclosure Statement Hearing may be adjourned from time to time by the Bankruptcy Court or the Debtor without further notice other than an adjournment announced in open court or the filing of a notice or hearing agenda providing for the adjournment on the docket of this chapter 11 case.
